Cancellation and Refunds Policy

"Skylum" is a trading name used by Shinyfields Limited, a Cyprus limited liability company, and its certain affiliates (collectively, "we" or "Skylum").

This Cancellation and Refunds Policy ("Policy") forms an integral part of Skylum's Terms of Use available at https://skylum.com/terms-of-use ("Terms of Use") and governs your potential cancellation of subscriptions and refunds of Products (as defined in the Terms of Use) purchased from us.

1. Limited money back guarantee

   If you purchased (i) a license to Skylum's software, or (ii) an upgrade of your lifetime license to the software directly from a Skylum's website and you are not completely satisfied with software for any reason, we will refund the fees you paid for the the software (less any applicable taxes or other fees) at any time within the following periods after the date of purchase:

   • for Luminar products – 30 days;
   • for Aperty – 14 days.

   This money back guarantee does not apply to any third-party products that may be sold on our websites, as well as to any non-software Products.

   For the avoidance of doubt, in respect of subscriptions, the money back guarantee only applies to the first time you are billed for a subscription. It is your responsibility to manage your subscription preferences. We will not refund any subscription renewal payments, whether due to your oversight of upcoming renewal charges or for any other reason whatsoever.

   If you purchased a license to Skylum's software from an authorized reseller or distributor, through a third-party store or website (for example, through the Apple App Store or Microsoft Store), you must follow the terms and conditions of that authorized reseller or distributor, store or website, authorized reseller or distributor with respect to any returns and/or refunds. Any applicable returns and/or refunds shall be made only through the authorized reseller or distributor, store or website, and not from Skylum.

   Please note that a lifetime license and a subscription license to the same software are two different Products, which you may own simulteneously. They offer different access to Product Upgrades, Generative AI features, etc.

2. Subscriptions and cancellations

   If you purchase a Product under subscription model, you will be able to use the Product as long as your subscription is active.

   Your subscription will automatically renew at the end of its term and you will be automatically charged the subscription fee unless you cancel your subscription before it is renewed. We will send you subscription renewal reminders if required by applicable law.

   You may cancel your subscription at any time. As a result of cancellation, your subscription will not renew and all future charges will stop. However, your subscription will remain active and you will still be able to use the Product until the end of current subscription term.

3. No refunds for certain Products

   No refunds are offered for the following Products:

   • digital Products, including education content (such as video tutorials, e-books, guides and other similar materials) and professional content (such as photography presets, LUTs, textures, etc.); and
   • extra seats (additional device access) to our software.
4. Refund denials

   We may decline refund claims in the following cases:

   • Inability to use the Product in your computing environment or on your device;
   • Any actual or suspected fraud or misconduct, including without limitation, any credit or debit card fraud or violation of our Terms of Use or other agreements with you;
   • Inability to use the Product due to your error, lack of knowledge, inconvenience, or other subjective reasons; or
   • Mistakes made during purchase of a Product.
